Meeting:        Salem Licensing Board held Monday, December 12, 2011 at 5:30 pm in the third floor conference room, 120 Washington Street. Present were members Robert St. Pierre, Chairman and John Casey, Rick Lee, Investigator for the Board, Peter Baglioni and Lt. Ouellette and Melissa Pagliaro, Clerk.
        
Approved:       One Day Liquor License. Applicant: Linda Crawford.
        Ms. Crawford said  that this id for the second annual fundraiser for a friend of hers who passed away and this will raise scholarship money for a recipient at SSU. She said the event will be held at St. Johns the Baptist. She said they are working on getting the insurance certificate.
        Mr. Casey said they would have to pay the $100.00 fee because they are not a non-profit.
        Mr. Lee asked who would be serving.
        Ms. Crawford said there would be TIPS certified servers there.
        Mr. Casey asked the price of admission.
        Ms. Crawford said $10.00 and that they have also arranged for a police detail.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.
        
Approval:       Conversion of a Seasonal B&W license to an Annual B&W license.
        Mr. Casey said this was happening under the conversion law that was passed for the City.
        Ms. Rennard said that Licensing will submit a cover letter with these application to the director of the ABCC to possibly help expedite them.
        Mr. Casey suggested the licensee follow up on his own as well once the application is submitted.
        Mr. Schultz said he would be doing that.
        Mr. Casey motioned to approve the conversion.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.   

Discussion:     The Board had a brief continued discussion regarding the conversion fee for All Alcohol Licenses. Antonio Bettencourt of 62 on Wharf and Lee Wolf of The Lobster Shanty were present.
        Mr. St. Pierre said he was going to let Ms. Rennard speak about this.
        Ms. Rennard started by explaining how the LB came up with the fee for the B&W conversion as discussed in the previous meeting. She said that the LB looked the same way at the All Alcohol. She said they looked at the last sales from the time period that B&W sold for all alcohol. She said that last sale was around 45,000 where more current sales average between 50,000 and 80,000. She said that the LB thought it was fair to start at the 45,000 and deduct 25% from there.
        Mr. Casey said he felt that created a level playing field and agreed.
        Mr. St. Pierre said that his biggest issue is consistency and he feels this is fair and consistent.
        Mr. Lee said that he feels that this is fair and that he is in favor also.
        Mr. Bettencourt said that he just don’t know if it is worth 75% on a restricted license and Mr Wolf said he felt the same way. Mr. Bettencourt also asked about what the payment terms would be.
        Ms. Rennard said that for B&W the LB set the schedule at 3 years with 2 payments per year.
        Mr. Casey agreed it may not be worth it in a lease situation.
        Mr. St. Pierre said that because the conversion fee for All Alcohol will be more than double the payment schedule could be longer.
        Ms. Rennard said that the legislation states that the payment schedule have to be somewhere along the same terms but agrees that it would be ok over 5 years because of the larger amount. She also said there s time for these entire licensee to think about this and figure it out.
        Mr. Lee motioned to accept the fee for the all alcohol conversion at $33,750.00 with a 5 year payment plan.     
        Mr. Casey seconded.
        Mr. St. Pierre said all are in favor. Motion carries.

Approved:       Application for a Common Victuallers License for New Yorker Deli, 2 Paradise Road.
        Applicant: Ed Spinney and Mr. Garabedian.
        Mr. Garabedian said that this was going to be an authentic NY Deli that will replace what was the Black Cow.
        Mr. Spinney gave Mr. Casey a copy of the floor plan and menu for the file.
        Mr. Casey asked what the hours were going to be.
        Mr. Spinney said 7 days from 6am-9pm.
        Mr. Casey asked if there would be any remodeling.
        Mr. Spinney said no as the former owner put a lot of money into remodeling.
        Mr. Garabedian said that the only thing they will do is remove the high top tables and replace them with regular ones.
        Mr. Casey asked if there was going to be entertainment.
        Mr. Spinney said just televisions.
        Mr. Garabedian said they are existing TV’s and an electronic menu board and a radio system.
        Mr. Casey asked when they would be opening.
        Mr. Spinney said January 1st or shortly after.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Entertainment:
        Mr. Casey motioned to approve 3 TV’s, sound system and digital menu board.
        Mr. Lee seconded.
        Mr. St. Pierre said that all are in favor. Motion carries.
        
Approved:       Conversion from Seasonal B&W license to Annual B&W License. Applicant: Seaport Café, 215 Derby Street. Present: Cynthia and Greg Shea.
        Mr. Shea said he understands the payment terms are 15,000 over a three year period with 2 payments due a year.  He said he called ABCC to let them know the application is coming and that he will hand carry his application into Boston.
        Mr. Casey motioned to approve the conversion.
        Mr. Lee seconded.
        Mr. St. Pierre said that all are in favor. Motion carries.

Business:       ***Brief discussion about the law for Monday’s sales of alcohol following a Sunday Christmas. Nothing had been decided yet.
        
        ***Discussion regarding the Lodging House at 179 Boston Street. A report from Peter Baglioni is to be placed in the file. Mr. St. Pierre said the LB will take it under advisement.     

        ***The LB was going to vote to extend closing hours at restaurants and clubs on New Year’s Eve, but will do soon the 19th when it has been posted on the Agenda.
